Privacy Policy

1. ABOUT US AND THE PURPOSE OF THIS NOTICE
DSK Partners LLP (“DSK”, “we”, “us”, “our” and “ours”) is an accounting, tax and business
advisory practice. We are registered in England and Wales as a limited liability partnership
under number OC425238 and our registered office is at D S House, 306 High Street,
Croydon, CR0 1NG.

This notice will tell you how we look after your personal data, about your privacy rights, and
about our compliance with and your protections under Data Protection Legislation.
In this notice “Data Protection Legislation” means any applicable law relating to the
processing, privacy and use of personal data, including the UK GDPR, the Data Protection
Act 2018 and the Privacy and Electronic Communications (EC Directive) Regulations 2003,
as amended.

For the purpose of the Data Protection Legislation and this notice, we are the ‘data
controller’. This means that we are responsible for deciding how we hold and use personal
data about you, except where we are processing information on behalf of a client, for
example when providing certain payroll services. We are required under the Data Protection
Legislation to notify you of the information contained in this privacy notice.
Our Data Protection Point of Contact is Dhiraj Shah, who is responsible for assisting with
enquiries in relation to this privacy notice or our treatment of your personal data. Should you

noted at paragraph 11 (Contact Us), below.

2. THE KIND OF INFORMATION WE HOLD ABOUT YOU
The information we hold about you will depend on your relationship with us and the services
we provide. It may include:

  • your name and contact details;
  •  identification and identity-verification information;
  • tax information, including your Unique Taxpayer Reference and National Insurance
    number;
  • financial and banking information;
  •  information relating to your business, employment or investments;
  • correspondence and information you provide when you contact us;
  • information we are required to obtain to meet our legal and regulatory
    responsibilities; and
  • technical information relating to your use of our website, such as your IP address,
    browser information and website activity.

Where necessary for the services we provide, we may also process other categories of
personal information. We will only collect information that is relevant to the purpose for which
it is required.

Our website also uses cookies and similar technologies. Further information about the

3. HOW WE MAY COLLECT YOUR PERSONAL DATA

We obtain your personal data directly from you when you:

  • become a client or enquire about our services;
  • communicate with a member of the DSK team;
  • complete a form on our website;
  • subscribe to communications from us; or
  • provide information as part of the work we undertake for you.

We may also obtain your personal data indirectly, including from government and regulatory
bodies, professional advisers, financial institutions, employers, businesses with which you
are connected and publicly available sources, where it is appropriate and lawful to do so.

4. HOW WE USE PERSONAL DATA WE HOLD ABOUT YOU
UK data protection law requires us to have a lawful reason for using your personal data.
Depending on the circumstances, we may process your information because:

  • it is necessary to perform a contract with you, or your employer or our client, or to
    take steps at your request before entering into a contract;
  • we have a legal or regulatory obligation;
  • it is necessary for our legitimate interests or those of another organisation, provided
    those interests are not overridden by your rights;
  • you have given us your consent; or
  • another lawful basis applies in the particular circumstances.

Where we rely on consent, you can withdraw it at any time – see paragraph 9 (Right to
Withdraw Consent) below.

Where we process special category information or information relating to criminal offences,
we will only do so where an additional condition under data protection law permits us to.
We may also process your personal data for the purposes of our own legitimate interests,
provided that those interests do not override your own interests, rights and freedoms. This
includes marketing, business development, statistical and management purposes.

Situations in which we will use your personal data
We may use your personal data in order to:

  • provide accounting, tax, audit, advisory and related professional services;
  • carry out our obligations arising from any agreements entered into between you (or
    your employer or our client) and us;
  • communicate with you and respond to enquiries;
  • verify your identity and carry out required due diligence;
  • prepare accounts, tax returns and other financial or regulatory information;
  • process financial transactions;
  • maintain appropriate business and client records;
  • comply with our legal, professional and regulatory responsibilities;
  • prevent and detect fraud, financial crime and other unlawful activity;
  • operate, secure and improve our website and digital services;
  • provide you with information about tax, accounting, regulatory or business
    developments, DSK news and services that may be relevant to you, where data
    protection and electronic marketing rules allow us to do so; and
  • notify you about any changes to our services.

You can ask us to stop sending marketing communications at any time by using the
unsubscribe option provided or by contacting us directly.

In some circumstances we may anonymise or pseudonymise personal data so that it can no
longer be associated with you, in which case we may use it without further notice to you.

We may also process your personal data without your knowledge or consent, in accordance
with this notice, where we are legally required or permitted to do so.

Data retention

We will only retain your personal data for as long as it is needed for the purpose for which it
was collected and to meet our legal, regulatory, professional and insurance requirements.
The appropriate retention period varies according to the type of information and the services
we provide, taking into consideration the requirements of our business, any statutory or legal
obligations and the purposes for which the data was originally collected.

Change of purpose

Where we need to use your personal data for a reason other than the purpose for which we
originally collected it, we will only do so where that reason is compatible with the original
purpose. If we need to use your data for a new purpose, we will notify you and communicate
our legal basis for this new processing.

5. DATA SHARING
We do not sell your personal information.We will share your personal data with third parties where we are required by law, where it is
necessary to provide our services or administer the relationship between us, or where we
have another legitimate interest in doing so. Depending on the circumstances, this may
include:

  • HM Revenue & Customs and other government bodies;
  • regulators and professional bodies;
  • banks and financial institutions;
  • professional advisers;
  • software, cloud, IT and communications providers;
  • service providers and subcontractors working on our behalf; and
  • law enforcement agencies, courts or other authorities where disclosure is required or
    permitted by law.

We only permit our third-party service providers to process your personal data for specified
purposes and in accordance with our instructions, and we take appropriate steps to ensure
that any information processed on our behalf is protected.

We may also share your personal data with other third parties, for example in the context of
the possible sale or restructuring of our business.

6. TRANSFERRING PERSONAL DATA OUTSIDE THE UNITED KINGDOM (UK)
Some of the organisations and technology providers we use may process personal
information outside the UK.

7. DATA SECURITY
We take the security of personal data seriously and have put in place commercially
reasonable and appropriate organisational and technical measures designed to prevent it
from being accidentally lost, used or accessed in an unauthorised way, or altered or
disclosed. Access to personal information is limited to employees, agents, contractors and
other third parties who have a business need to know, who process personal data only on
our instructions and who are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected data security breach and will
notify you and any applicable regulator of a suspected breach where we are legally required
to do so.

8. RIGHTS OF ACCESS, CORRECTION, ERASURE, AND RESTRICTION
Your duty to inform us of changes
It is important that the personal data we hold about you is accurate and current. Should your
personal information change, please notify us by contacting us using the details in paragraph
11 (Contact Us) below.

Your rights in connection with personal data
Under certain circumstances, by law you have the right to:

  • request access to your personal data. This enables you to receive details of the
    personal data we hold about you and to check that we are processing it lawfully;
  • request correction of the personal data that we hold about you;
  • request erasure of your personal data, where there is no good reason for us
    continuing to process it, or where you have exercised your right to object to
    processing (see below);
  • object to processing of your personal data where we are relying on a legitimate
    interest (or those of a third party) and there is something about your particular
    situation which makes you want to object, or where we are processing your personal
    data for direct marketing purposes;
  • request the restriction of processing of your personal data, for example if you want us
    to establish its accuracy or the reason for processing it; and
  • request the transfer of your personal data to you or another data controller, where the
    processing is based on consent, carried out by automated means and this is
    technically feasible.

These rights do not apply in every circumstance and may be subject to legal or regulatory
exceptions.

You will not have to pay a fee to access your personal data or to exercise any of the other
rights. However, we may charge a reasonable fee for the administrative costs of complying
with the request if your request is manifestly unfounded or excessive, or we may refuse to
comply with the request in such circumstances.

We may need to request specific information from you to help us confirm your identity and
ensure your right to access the information (or to exercise any of your other rights). This is
an appropriate security measure to ensure that personal information is not disclosed to any
person who has no right to receive it.

9. RIGHT TO WITHDRAW CONSENT
In the limited circumstances where you have provided your consent to the collection,
processing and transfer of your personal data for a specific purpose (for example, in relation
to direct marketing), you have the right to withdraw your consent for that specific processing
at any time. To withdraw your consent, please email our Data Protection Point of Contact at
dhiraj.shah@dskllp.com, or use the unsubscribe option provided in our marketing
communications.

Once we have received notification that you have withdrawn your consent, we will no longer
process your personal data for the purpose or purposes you originally agreed to, unless we
have another legitimate basis for doing so in law.

10. CHANGES TO THIS NOTICE
We keep this privacy notice under review and may update it from time to time to reflect
changes to our services, technology or legal and regulatory requirements. Any changes we
make will be reflected in an updated version of this notice, available on our website.
